Administrative Area – The sale property is within the administrative area of the East Riding of Yorkshire Council, County Hall, Beverley, East Yorkshire, HU17 9BA.

Agricultural holding number – The sale property forms part of a larger holding and the agricultural holding number will be retained by the seller.

Alternative Use – The land may be considered to be suitable for a solar farm subject to the usual consents first being obtained and the overhead line having the appropriate capacity.

Ancient Monument – The sale property or any part thereof is not registered as an ancient monument under the Ancient Monuments and Archaeological Areas Act 1979.

Basic Payment Scheme – The seller retains the payment for the current scheme year and the buyer will comply with the cross compliance requirements from completion to and including 31st December. No Basic Payment Scheme entitlements are included in the sale.

Boundaries – In the past the seller has maintained the roadside boundary.

Coastal Erosion – At present erosion rates the sale property is not considered to be at risk from coastal erosion within the next 100 years.

Completion – A completion date will be agreed on exchange of contracts.

Conservation Area – The sale property does not lie in or immediately adjacent to a Conservation Area.

Contaminated Land – The seller is not aware of any part of the sale property having been filled with any contaminating material or matter referred to in the Environmental Protection Act 1990. The seller does not give any warranty or guarantee in this respect and advises prospective buyers to make such enquiries and investigations as may be necessary to satisfy the

prospective buyer or buyers that none of the sale property is so filled or contaminated.

Countryside Stewardship Agreement. The sale land, with other land, forms part of a Countryside Stewardship Agreement number 1059656 with an end date of 31 December 2025. The following options are within the agreement.

The Buyer will covenant with the Seller within 30 days of Completion to obtain, complete and return to Rural Payments Agency a Transfer Request Form in respect of the purchased land. The intention being to create a separate Countryside Stewardship agreement in respect of the purchased/sale land, the term of which will be the same terms as existing agreement. Failure to comply will result in the Seller being obliged to make repayment to the Rural Payments Agency in respect of the entire Countryside Stewardship agreement ("the Repayment"). The Buyer shall indemnify the Seller in respect of the Repayment and any costs associated therewith due to the failure of the Buyer in complying with this requirement.

Description of the Land – The sale property is within the Foggathorpe 2 Association of Soils as identified by the Soil Survey of England and Wales.

Drainage –
Part of the Sale Property was drained in 2015 but presently drainage plans cannot be found. Another part was drained in 2011 and drainage plans are available. A further part was drained in the 1970’s but no plans are available.

Employment – Transfer of Undertakings (Protection of Employment) Regulations 1981 – The sale property is not sold as a going concern and the seller will indemnify the buyer against any obligation which is passed to the buyer under the aforementioned regulations.

Entry – on completion

Environment Agency – The seller is not aware of any reported pollution incidents effecting the sale property.

Environmentally Sensitive Area – The sale property is not within an Environmentally Sensitive Area.

Environmental schemes – The land is part of a Mid Tier Countryside Stewardship Agreement number 1059656 Agreement End Date 31 December 2025. Hedge options affect the Sale Property i.e. not to cut more than 50% of all hedges in any one calendar year, save for annual cutting in the interests of public safety. Flood Risk – The sale property is within an area benefitting from flood defences as shown on maps published by the Environment Agency.

Forestry – The sale property is not subject to any forestry schemes or agreements.

Genetically Modified Organism – The sale property has not knowingly been used for the growing of experimental genetically modified organisms or crops.

Health and Safety – When viewing please take such steps as may be reasonably necessary to ensure your safety.

Legal Agreements –

The Title refers to a transfer dated 10 August 2009 which contains a Restrictive Covenant precluding the use of the land for wind turbines or a wind farm. This covenant will not prevent the use of the land as a solar farm. Also a transfer dated 24 January 2014 provides that nothing shall be done to impede the use of natural watercourses and drainage systems.

There is a Deed of Grant dated 9 March 1981 in favour of Yorkshire Water Authority relating to a water main.
