FIRST HOME QUALIFYING CRITERIA What is the First Homes scheme?

The First Homes scheme is a government initiative designed to provide local houses for first-time buyers, by getting them on the property ladder, by offering new builds with a discount of at least 30% compared to market prices. This discount will apply to the First Home forever.

Summary of most important criteria.

1 A sale price being 70% of market price (but not more than £250,000 after discount)

2 A first-time buyer.

3 A mortgage of 50% or more with a minimum deposit of 5%.

4 An income (joint income) not exceeding £70,000 per annum.

5 A local connection, member of the Armed Forces or a Key Worker (not yet defined).

6 Ability to let in certain circumstances.

7 Ability to rent a room.

8 A "First Home" shall remain a "First Home"

The following is detailed information.

1 "Compliance Certificate" means a certificate issued by the East Riding of Yorkshire Council ("the Council") confirming that a dwelling is being disposed of as a First Home to a purchaser who meets the Eligibility Criteria (National) and Eligibility Criteria (Local) (if still applicable). Such certificate is required from the Council in order to dispose of the First Home.

2. "Discount Market Price" means a sum which is the Market Value (assessed by an independent valuation in accordance with RICS Valuation Standards) discounted by at least 30%.

3 "Eligibility Criteria (National)" means criteria which are met in respect of a purchase of a First Home if: the purchaser is a First Time Buyer (or in the case of a joint purchase each joint purchaser is a First Time Buyer); and the purchaser’s annual gross income (or in the case of a joint purchase, the joint purchasers’ joint annual gross income) does not exceed the Income Cap (National) (£80,000).

4 "Eligibility Criteria (Local)" means criteria (if any) published by the Council at the date of the relevant disposal of a First Home which are met in respect of a disposal of a First Home if: The purchaser’s annual gross income (or in the case of a joint purchase, the joint purchasers joint annual gross income) does not exceed the Income Cap (Local) (£70,000); and
Any or all of criteria (i) (ii) and (iii) are met: the purchaser is (or in the case of a joint purchase at least one of the joint purchasers is) an Armed Services Member and/or the purchaser meets the Local Connection Criteria (or in the case of a joint purchase at least one of the joint purchasers meets the Local Connection Criteria); and/or the purchaser is (or in the case of a joint purchase at least one of the joint purchasers is) a Key Worker.
5 "Armed Services Member" means a member of the Royal Navy the Royal Marines the British Army or the Royal Air Force or a former member who was a member within the five (5) years prior to the purchase of the First Home, a divorced or separated spouse or civil partner of a member or a spouse or civil partner of a deceased member or former member whose death was caused wholly or partly by their service.

6 "Local Connection Criteria" means criteria which are met by a person who satisfies one or more of the following:
6(a) resident in the area of the East Riding of Yorkshire for at least six months out of the last twelve months or three out of the last five years;
6(b) the person has parents, grandparents, adult children, grandchildren, a brother or a sister currently living within the East Riding who have been normally resident within the East Riding of Yorkshire for at least five years; or
6(c) the person is employed in the East Riding of Yorkshire and has been for at least I year with a minimum of 20 hours work per week; or
6(d) such other local connection criteria as may be published by the Council from time to time as its "First Homes Local Connection Criteria" and which is in operation at the time of the relevant Disposal of the First Home and for the avoidance of doubt any such replacement criteria in operation at the time of the relevant Disposal of the First Home shall be the "Local Connection Criteria" which shall apply to that Disposal.

7 "Key Worker" means such categories of employment as may be published by the Council from time to time as the "First Homes Key Worker criteria" and is in operation at the time of the relevant Disposal of the First Home and for the avoidance of doubt any such replacement criteria in operation at the time of the relevant Disposal of the First Home shall be "Key Worker" criteria which shall apply to that Disposal. The following may be a guide to those who may be classed as Key Workers: "critical or essential workers is a public-sector or private-sector employee who is considered to provide an essential service". This criterion remains to be designated by the Council.

8 "First Time Buyer" means a first-time buyer as defined by paragraph 6 of Schedule 6ZA to the Finance Act 2003.
6 (1) In this Schedule "first-time buyer" means an individual who-
(a) has not previously been a purchaser in relation to a land transaction the main subject-matter of which was a major interest in a dwelling,
(b) has not previously acquired
an equivalent interest in a dwelling situated in a country or territory outside England, Wales and Northern Ireland, or
an interest of a kind mentioned in section 117(2) (an estate in fee simple absolute or a term of years absolute subsisting at law or equity) in a dwelling situated in Wales
(c) has not previously been, or been one of the persons who was, "the person" for the purposes of section 71A (land sold to financial institution and leased to person) or 73 (land sold to financial institution and re-sold to person) in a case where the main subject-matter of the first transaction within the meaning of the section concerned was a major interest in a dwelling, and
(d) would not have been such a person for those purposes in such a case if the provisions mentioned in paragraph (c) had been in force, and had had effect in the country or territory concerned at all material times (subject, where required, to appropriate modifications).
(2) For the purposes of sub-paragraph (1)(b) and (d), ignore a lease or, in the case of a dwelling situated in Wales, a term of years absolute which has less than 21 years to run at the beginning of the day after the date on which it is acquired.

9 "Letting", the First Home shall be the purchaser’s main residence. A First Homes Owner may let their First Home for a fixed term of no more than two (2) years with prior notification given to the Council or for a longer period (subject to the prior agreement of the Council, in connection with employment requirement to live elsewhere, Armed Forces deployment, escaping risk of harm, breakdown in relationship, redundancy and provision of care from another). There is no restriction on renting a room.

10 Marketing, the Dwelling must be actively marketed as a First Home for 6 months (the Eligibility Criteria (Local) shall apply for 3 months). If it has not been possible to dispose of the dwelling as a First Home within this period (or a reduced period if marketing for that time would cause undue hardship) then the owner of the dwelling can apply to the Council to remove the First Home requirement. The Council may then direct the dwelling to be transferred to them as a First Home. If not, and the Council is satisfied that the marketing requirements have been complied with, then a payment of the lesser of 30% of the proceeds of sale or the amount received after payment of the mortgage can be made to the Council and the dwelling will then no longer be subject to the First Home obligations.

11 Mortgage requirements, not less than 50% of the purchase price must be funded by a first mortgage or other home purchase plan with a Mortgage lender.

12 Mortgage lenders, the following amongst others, may provide mortgages; Halifax,
Nationwide and Leeds, Chorley, Darlington, Mansfield and Newcastle Building Societies.
